By using this site you agree to a few things, mostly about how listing data works and what we can and cannot promise. Plain English notes are in the colored boxes. The legal version is the binding one.

Acceptance of these terms

By accessing or using bandonbythedunesrealtee.com (the "Site"), you agree to be bound by these Terms of Use, our Privacy Notice, and any additional terms referenced below or posted elsewhere on the Site. If you do not agree, do not use the Site.

These terms are a binding contract between you and Bandon By The Dunes Realtee, a sole proprietorship operating in Bandon, Oregon (referred to in these terms as "we," "us," or "the Brokerage").

About us

Bandon By The Dunes Realtee is a real estate brokerage located at 1095 Alabama Ave SE, Ste A, Bandon, Oregon 97411. Our office line is 541-347-7833. The brokerage is operated by Barry Winters, Principal Broker (Oregon REA #PB.780303667), with Jodie VanLeuven, Broker (Oregon REA #980300174). Both licensees are regulated by the Oregon Real Estate Agency under Oregon Revised Statutes Chapter 696 and Oregon Administrative Rules Chapter 863.

Listing data and the IDX program

Property listings shown on this Site come in part from the Internet Data Exchange (IDX) program of the Regional Multiple Listing Service of Portland, Oregon, also referred to as RMLS™. We participate in this feed under a written subscriber agreement with RMLS™.

The following terms apply to all listing data displayed on this Site:

  • Listing data is provided for your personal, non-commercial use. You may not use it to build a competing listing service, repackage and resell listings, send unsolicited communications to listing brokers, or scrape the data through automated means.
  • Real estate listings held by brokerage firms other than Bandon By The Dunes Realtee are marked accordingly and include the name of the listing brokerage.
  • Listing data is copyright © 2026 RMLS™, Portland, Oregon, and is displayed under license.
  • The data is refreshed automatically from RMLS™ on a regular cadence (currently every 15 minutes). Between refreshes, a listing may be out of date. A property shown as active here may have already gone under contract, sold, or been withdrawn.
  • If RMLS™ requests removal of a specific listing or this Site loses its IDX participation, the listing display will be removed or modified as required by RMLS™.
Plain English. The listings are pulled from a regional database that we have permission to display. They are usually current to within 15 minutes. Treat them as a starting point and confirm any property with us before making decisions.

Accuracy and limitations of listing information

All information provided on this Site is deemed reliable but is not guaranteed and should be independently verified. This includes square footage, lot size, bedroom and bathroom counts, year built, school assignments, zoning, tax records, flood zone status, easements, HOA fees, included features, and the descriptive text written by listing brokers. Errors and outdated information do occur.

Before you make any decision based on what you see here, including writing an offer, agreeing to a purchase, or arranging financing, verify the information directly with the listing brokerage, the county records office, the relevant municipal authority, and any inspectors, surveyors, or other professionals you choose to engage.

We make no representation that the photos shown for any listing depict the current condition of the property. We make no representation regarding the legal description, title status, or any encumbrances. We are not a substitute for a title search, an inspection, an appraisal, or legal counsel.

Acceptable use

When using the Site, you agree not to:

  • Use the Site for any unlawful purpose or in violation of any local, state, federal, or international law
  • Use any automated means (bot, scraper, crawler, or similar tool) to access or copy listing data, except by standard search engines indexing the Site under the directives in our robots.txt
  • Attempt to gain unauthorized access to any portion of the Site, the underlying systems, or any related networks or infrastructure
  • Interfere with, disrupt, or place an unreasonable load on the Site, including attempting to bypass rate limits or anti-bot measures
  • Submit false, misleading, or fraudulent information through any form on the Site
  • Use the Site to harvest contact information about listing brokers or property owners for solicitation
  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site or the listing data for any commercial purpose without our prior written consent and the consent of RMLS™

Intellectual property

The Site itself, including its design, layout, photographs taken by the Brokerage, written copy, organization, code, and brand elements (the "Bandon By The Dunes" wordmark, "Realtee" mark, and the coastal lighthouse glyph), is owned by Bandon By The Dunes Realtee or its licensors and is protected by copyright and trademark law. You may not copy, modify, distribute, or create derivative works from any of it without prior written permission.

Listing photographs are the property of the listing brokerages that contributed them through RMLS™. Display on this Site does not transfer any rights.

Photographs of Barry Winters and Jodie VanLeuven appearing on this Site, including images from the cranberry harvest, are the property of Barry and Jodie and are used here with their consent. Photographs of Bandon scenery, Old Town, the coast, and other location imagery (excluding RMLS™ listing photos) are the property of Preston Winters of Winters Code and are used under license to the Brokerage. None of these images may be downloaded, copied, or reused without the written permission of the rights holder.

Third party links and services

The Site links to and uses services provided by third parties, including RMLS™, Google (Maps and Places), Cloudflare (hosting, security, analytics, and forms), and others. We are not responsible for the content, accuracy, privacy practices, or terms of those third parties. Your use of those services is governed by their own terms and privacy policies.

Not legal, financial, or tax advice

Nothing on this Site is intended as legal, financial, tax, insurance, or accounting advice. Real estate decisions have material financial and legal consequences. Before you sign a purchase agreement, accept an offer, take out a loan, sign a lease, or take any other action with significant consequences, consult with appropriately licensed professionals (an attorney, a CPA, a mortgage broker, a title officer, a home inspector, or another real estate professional, as your situation calls for).

Information about market trends, neighborhoods, property values, school assignments, taxes, or any other topic on this Site is general in nature, may be out of date, and is not a substitute for verified, current information specific to your transaction.

Fair Housing

We do business in accordance with the Federal Fair Housing Act (42 U.S.C. § 3601 et seq.) and Oregon's fair housing statutes (ORS Chapter 659A). We do not discriminate in the showing, listing, sale, rental, or financing of real estate based on race, color, religion, sex, handicap, familial status, national origin, sexual orientation, gender identity, source of income, marital status, or age.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY OREGON LAW, IN NO EVENT WILL BANDON BY THE DUNES REALTEE, ITS LICENSEES, OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ANY CONTENT, REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, NEGLIGENCE, STATUTE, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

Nothing in these terms limits any liability that cannot be limited under applicable law, including liability arising from intentional misconduct or from a brokerage's professional duties under Oregon real estate law in the context of an actual client representation.

Indemnification

You agree to indemnify and hold harmless Bandon By The Dunes Realtee, Barry Winters, Jodie VanLeuven, and any other licensees associated with the brokerage, from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site in violation of these terms, your violation of any law, or your infringement of any third party right.

Governing law, venue, and dispute resolution

These terms and your use of the Site are governed by the laws of the State of Oregon, without regard to its conflict of laws principles. Any dispute arising out of or relating to these terms or the Site will be brought exclusively in the state or federal courts located in Coos County, Oregon, and you consent to the personal jurisdiction of those courts.

You agree to first attempt to resolve any dispute informally by contacting us at the address below and giving us at least 30 days to respond before filing any formal action.

Changes to these terms

We may update these terms at any time. The effective date at the top reflects the most recent update. We will post material changes prominently on the home page for a reasonable period. Continued use of the Site after a change means you accept the updated terms. If you do not agree to a change, your remedy is to stop using the Site.
